Please read these terms and conditions of use carefully before using any materials, information or services. By accessing https://www.chubcay.com or making an online/phone or walk-in reservation, you agree to accept, without limitation or qualification, all of these terms and conditions of use.
Ownership:www.chubcay.com (the "website") offers information on the CHUB CAY HOTEL, which is managed and operated by the Gekabi Bahamas LTD (collectively, "we" or "us"). Access to and use of the websites is subject to any specific terms and conditions set forth on the individual pages within the websites and these terms and conditions of use (collectively, the "terms"). We reserve the right at any time to change any of the terms and conditions contained herein or any information contained in the websites. By using the websites, you agree in advance to accept any such changes.
Risk Recognition:Chub Cay is a remote island in the Bahamas with unique resources. Utilities like power, water, sewer, and the internet can go down from time to time without notice. We do not offer any compensation should any or all utilities have an outage during your stay. We will do our best to keep you informed of the status of any planned and unplanned outages.
IMPORTANT: There is a limited medical facility on the island. We encourage all guests to have their own personal evacuation plan should there be a medical emergency.

By creating a reservation as a "Temporary Member with Limited Access," you hereby agree to to all membership rules as well as the declarations of covenants, conditions, easements and restrictions for the Chub Cay Club dated September 29, 2005.
Only reservations/renters created and accepted for stay in property considered in the official Chub Cay Resort and Marina Club rental pool are eligible to be considered for temporary membership - limited access. Reservations and "combined stays" in which a renter may be staying both within the rental pool and in a separately/privately owned slip or home are not eligible for temporary membership.
Accepted Temporary Membership as defined in the terms above once granted will incur a fee of $19 and are valid until Dec. 31st, 2023. Temporary Members have limited access to the Clubhouse Restaurant and Lobby, Tiki Bar & Pool, Nauti Rooster, Marlin Market & Posh Peacock, and Chub Cay Spa.
Temporary Membership purchase is NOT available for property (slip AND home) owners and their families, friends, vendors and employees under any circumstances.
Temporary Membership program applicants are to be vetted by the Club's management and can be rejected on application or revoked after acceptance for failure to adhere to member guidelines and rules of the Club's discretion. The sole remedy for this issue is refund of temporary membership fee.
Day Pass:Days passes are sold on a first come first serve basis. They may not be available on holidays or special occasions. We strongly recommend you purchase ahead of time. They are available on our website 24/7. Day passes are valid from 7:00 am to 5:00 pm. Each vessel must leave the marina by 5:00 pm.
Gift Cards:Gift cards expire one year after issue. Any balance left will be forfeited. We are not responsible for lost or stolen gift cards. If your card is lost or stolen please contact us immediately.
Booking & Rates:Rates are not guaranteed until a deposit for the requested stay has been taken. Rates are subject to change at any time for any reason. Confirmed reservation price is final and non-negotiable. By agreeing to the rate plan you are contracted to adhere to the below regulations and are accepting the terms and conditions in its entirety. Guests may reserve up to two (2) resort accommodations and two (2) marina accommodations during one period. Exceptions/Changes to this policy may be made at management's sole discretion.
Non-Refundable Rate:PLEASE READ THESE TERMS CAREFULLY. YOU HAVE A LIMITED TIME TO CANCEL THIS RESERVATION.
This rate plan requires full payment at the time of reservation. You can cancel this reservation within 24 hours of booking. The booking time is the date/time stamp on the confirmation email sent, even if not received. After this period, the reservation is non-cancellable/non-modifiable. Reservations can not be transferred to another name.
In the event of force majeure or any circumstances, your sole remedy is for you to able to retain your funds as a credit for a future booking provided as per the policy herein.
The future booking must be made within twelve months of the original booking, and the arrival date must not be greater than eighteen months from the original booking date. It's agreed there will be a $199 re-booking fee.
Without exception, no cash will be refunded, or credit will be issued. You agree to pay our reasonable attorney fees and collection costs should you dishonor this agreement.
Best Available Rate:
*Modifying Dates* - Please be advised that if you change the dates on your reservation within 72 hours of your arrival, there will be a $149.00 change fee if you've booked a hotel/lock out room, beach cabana or a villa. If you've booked dockage and make changes to the reservation dates within 72 hours of the arrival date, you will pay a change fee of $99.00. If you make changes to your reservation dates prior to the 72 hours you are not required to pay a change fee.
- 30% of your stay will be collected at the time of booking. This amount becomes your booking deposit. Your accommodations are not considered guaranteed until this is collected.
- Full refund if cancellation is more than 72 hours in advance.
- If cancelled within 72 hours, one night room and tax will be charged as a cancellation fee.

*No Shows - If you have an existing reservation and you do not show up on the arrival date, you will pay for one night plus tax and your deposit will be forfeited*
Easy Cancellation/Fully Flexible Rate:Your reservation is not guaranteed until a thirty-percent deposit of your estimated stay is collected. Bookings may be canceled by 3:00 PM the day before the arrival date without charge. If you do not cancel by 3:00 PM the day before your arrival, you will owe the lesser of your deposit or one night stay.
If you change your reservation and are not eligible for a refund, you will be charged the current rates plus a courtesy change fee of $99.
If you are a 'no-show' by 8:00 pm on your scheduled arrival date, we will retain the lesser of your deposit or one night's stay. The balance of your reservation will be canceled.
We do not accept telephone cancellations. Only written cancellations sent to email@example.com will be accepted. The choice of law is the Commonwealth of the Bahamas.
The Spa at Chub Cay Cancellation PolicyOur spa treatments are reserved especially for you. We value your business and ask that you respect the spa's scheduling policies. Should you need to cancel or reschedule, please notify us the evening before your scheduled appointment. Cancellations will only be accepted by email to firstname.lastname@example.org or email@example.com.
Same-day cancellations will result in a cancelation fee of $75 per treatment booked. No-show appointments are subject to a cancellation fee amounting to 100% of the cost of the scheduled service. Appointments made the same day must be canceled within 1 hour of booking to avoid the cancellation fee. If you are late for your appointment, our therapists will do their best to accommodate you, however you will be charged for your full appointment regardless. We recognize the time of our clients and staff is valuable and have implemented this policy to ensure you receive the best service possible. We appreciate your understanding.
When you schedule your appointment with us, you are agreeing to these policies.
Resort Credits:Credits are valid for up to one year (365 days) of date applied to folio. Credits are non-transferable to other persons and do not equal cash.
VAT & Gratuity:12% Bahamian Value Added Tax is added to all services rendered and products purchased.
The Clubhouse Restaurant & Bar checks have a customary 18% automatic gratuity applied to all checks.
- During peak seasons, a deposit to hold dinner reservations may be required for parties of 8 guests or more at $10 per person. Cancellation for said dinner reservation must be made by 4 p.m. the night of to avoid charges.
Request for Copies of Receipts:Please review your folio prior to leaving. Should you have any questions regarding your folio, while still on island, our front desk team will assist in locating receipts.
If you leave without checking out, you waive the right to review charges. A copy of your overall folio (displaying only transaction dates and totals) will be emailed to you at request, however, if you request back-up for individual receipts accumulated during your stay, a research fee of $1.50 per sheet will be charged. Please allow 5-7 business days to collect information.
Revisions to Reservations:If you need to change the length of stay or travel dates of your reservation, it is subject to availability and may result in a rate change. Adding additional guests may also result in a rate change.
Hotel Check-In/Check-Out:Check-In: 4 p.m.*
Check-Out: 11 a.m.
*Check-in times may vary based on hotels discretion. Additional fees may be charged for early check-in/late check out.
Credit card and photo ID matching the name on the credit card must be presented at check-in. A temporary authorization of $100 will be placed on the credit card.
Proof of Citizenship:As you will be traveling to another country, you must present proof of citizenship. A valid passport must be presented at check-in for each guest.
Modification to our Services:We reserve the right at any time and from time to time to modify, suspend, discontinue, or terminate our services (or any part thereof) with or without notice. You agree that we will not be liable to you or to any third party for any modification, suspension, discontinuation, or termination of our services.
Sea Pass:By subscribing to the Sea Pass you are entitled to savings* on resort and marina accommodations!
Only the owner and/or operator of the vessel are allowed to make reservations under the Sea Pass rate. Sea Pass membership must be valid throughout the entire length of stay to receive said discount(s).

The "Sea Pass" rate can be booked up to 31+ days in advance.
All reservations can be cancelled up to 48 hours prior to the arrival date.

Annual Subscription: Non-refundable or cancellable once purchased. ($599 + VAT)
2 Year Subscription: Non-refundable or cancellable once purchased. ($999 + VAT)
*Sea Pass discounts may not be applied to or combined with any "Extended Stay" discounts or current promotions.
Hurricane Policy:If a major hurricane is destined to hit the Bahamas or your hometown during the dates of your stay, you can change your reservation.
If you are presently on Chub Cay when a hurricane threat is issued within 250 nautical miles, and have already pre-paid for your stay, you will be given a refund for the remaining nights of your stay should evacuation become necessary or you decide to leave.
- Reservation must be re-booked within 90 days of intended check-in.
- Reservation must be completed within one year of original stay dates.
- Changed dates to peak season/holidays are subject to surcharges.
- Changes/Cancellations must be made in writing to email@example.com within 48 hours of intended arrival.
In the event of a severe storm system threat with adequate notice, you may be asked to evacuate the island. Evacuation is highly recommended when a storm is present within 250 nautical miles of the island. As we are an out island with limited medical resources and provisioning supplies, this is for your safety.
For safety, we may shut down power and water to clubhouse and marina accommodations between 24 and 48 hours in advance of storm fall. Fuel sales will also be appropriately rationed in order to preserve supply in case of emergency to run the generators that supply power to the island.
Guests and Captains are personally responsible for the safety of themselves and their property.
In the event of extreme/sudden emergency, the category 5 rated boat shed structures serve as shelter. Provisioning shall be provided upon request.
Lost Keys:Any key(s) not returned at time of departure will result in a charge of $125 per key.
LIMITATION OF LIABILITY:YOU UNDERSTAND AND AGREE THAT WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, ANY LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, COST OF PROCUREMENT OF SUBSTITUTE SERVICES, OR ANY OTHER INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, HOWSOEVER CAUSED, AND ON ANY THEORY OF LIABILITY, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), OR OTHERWISE RESULTING FROM: (1) THE USE OF, OR THE INABILITY TO USE, OUR SITE AND/OR SERVICES, (2) THE COST OF PROCUREMENT OF SUBSTITUTE SERVICES AND GOODS, (3) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, (4) THE STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON OUR SITE, (5) RELIANCE ON CONTENT OR POSTINGS ON OUR SITE, OR (6) ANY OTHER MATTER RELATING TO OUR SITE OR OUR SERVICES. THESE LIMITATIONS WILL APPLY WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
EXCEPT AS REQUIRED BY THE INDEMNITY PROVISIONS HEREIN, IN NO EVENT WILL OUR DIRECT LIABILITY HEREUNDER EXCEED THE ACTUAL TOTAL AMOUNT RECEIVED BY US FROM YOU TO ACCESS OUR SITE AND/OR THE SERVICES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
INDEMNIFICATION:You agree to indemnify and hold us and our subsidiaries, and affiliates, and their officers, members, directors, employees and agents harmless from and against any and all liability, losses, claims, demands, disputes, damages or costs of any kind, including, without limitation, reasonable attorneys' fees and costs of litigation, resulting from or in any way connected with (a) your use of or reliance on our services, (b) your connection to our Site, (c) your violation of this these Terms and Conditions or (d) your violation of any rights of another party.
LIMITATION OF ACTIONS BROUGHT AGAINST US:You agree that any claim or cause of action arising out of your use of our Site or these Terms and Conditions must be filed within one year after such claim or cause of action arose or it shall forever be barred, notwithstanding any statute of limitations or other law to the contrary. Within this period, any failure by us to enforce or exercise any provision of these Terms and Conditions or related right shall not constitute a waiver of that right or provision.
Only the reservation as entered into and confirmed by our system will be honored. Any written or printed confirmation that has been altered may be rejected by the hotel.
